What this site is for
The Site provides general information about food variety, recipes, and everyday eating in a New Zealand context. Content is for education and lifestyle purposes only. It is not medical, dietetic, psychological, or other professional health advice. You should seek advice from a qualified practitioner (for example, your GP or a New Zealand Registered Dietitian) about matters affecting your health.
Nothing on the Site creates a client–practitioner relationship unless we confirm a paid or free consultation in writing.
Accuracy and Fair Trading Act 1986
We aim to present information that is accurate and helpful at the time of publication. Nutrition figures and seasonal availability may change. We do not make misleading claims about outcomes from following general tips on the Site. If you believe Site content is inaccurate, contact us and we will review it.
How you may use the site
You may view and download content for personal, non-commercial use. You must not:
- Copy, scrape, or republish substantial parts of the Site for commercial purposes without our written permission.
- Attempt unauthorised access to our systems or other users’ data.
- Upload unlawful, defamatory, or harmful material through contact forms.
- Use the Site in a way that breaches New Zealand law (including the Harmful Digital Communications Act 2015).
- Impersonate another person or provide false contact details.
Intellectual property (Copyright Act 1994)
Unless stated otherwise, we own or license copyright in text, images, logos, layout, and code on the Site. You may print one copy of a page for personal reference. Any other reproduction, adaptation, or public display requires our prior written consent.
Consultations, workshops, and paid services
If you book a session or event:
- We will confirm price (if any), what is included, date, format (in person or online), and cancellation terms in email or a separate agreement.
- Browsing the Site does not by itself create a booking.
- If you are a consumer under the Consumer Guarantees Act 1993 (CGA), our services must be carried out with reasonable care and skill and be fit for any particular purpose you tell us about. Nothing in these terms limits your non-excludable rights under the CGA.
- If you are acquiring services for business purposes and the CGA does not apply, our liability is limited as set out below.
Cancellation and refunds
Cancellation and refund rules for paid services will be stated at the time of booking. Where the CGA applies and a service fails a consumer guarantee, you may be entitled to a remedy (repair, refund, or compensation depending on the circumstances).
Privacy and electronic messages
Our Privacy Policy and Cookie Policy explain how we handle personal information. Marketing messages are sent in accordance with the Unsolicited Electronic Messages Act 2007 and only with your consent where required.
Links to other websites
The Site may link to third-party websites (for example, map providers). We do not control those sites and are not responsible for their content or privacy practices.
Disclaimer of liability
To the maximum extent permitted by law:
- The Site is provided “as is”. We do not guarantee uninterrupted or error-free access.
- We are not liable for indirect or consequential loss (including loss of profit, data, or opportunity) arising from use of the Site or reliance on general information published here.
- Our total liability for any claim relating to the Site (other than liability that cannot be excluded by law) is limited to NZD $100 or the amount you paid us in the 12 months before the claim, whichever is greater.
Nothing in these terms excludes liability that cannot be excluded under New Zealand law, including rights and remedies under the Consumer Guarantees Act 1993, the Fair Trading Act 1986, or for death or personal injury caused by our negligence.
Indemnity
You agree to indemnify us against losses arising from your breach of these terms or misuse of the Site, except to the extent caused by our fault.
Online advertising (Google Ads and similar)
We may advertise this website in New Zealand through Google Ads or similar services. Advertisements describe food education and meal ideas only. We do not use misleading claims, guaranteed outcomes, or bait-and-switch pricing. The landing page URL is always on earthwrist.world and reflects the ad topic. Paid session fees are confirmed in writing before you pay.
Disputes
Please contact us first to resolve any concern. If we cannot resolve a dispute, you may pursue remedies available under New Zealand law. Consumers may also contact the Commerce Commission (www.comcom.govt.nz) about certain trading issues.
Governing law and jurisdiction
These terms are governed by the laws of New Zealand. You submit to the non-exclusive jurisdiction of the New Zealand courts. If you live in a country where mandatory consumer laws give you additional rights, those laws apply to the extent they cannot be contracted out of.
Changes to these terms
We may update these terms. The “Last updated” date will change. Continued use of the Site after changes are posted means you accept the revised terms, except where further consent is required by law.
